New York Gourmet Eateries Agree to $1.2 Million Settlement for Overtime Pay and Other Wage-Hour Violations

Following an investigation by the New York State Department of Labor, New York’s Amish Market, Zeytinia, Zeytinz and Zeytuna, which provide “on the go” gourmet cuisine to their customers, agreed to pay almost $1.2 million to resolve New York minimum wage and overtime pay law violations.


In addition to their failure to pay employees 1-1/2 times their hourly rate for hours worked over 40, it appears, according to the New York State Department of Labor, that some new employees were paid a subminimum wage during a “trial period,” instead of the required minimum wage.
Under New York law, the current minimum wage is $7.15 per hour. It is scheduled to increase in July 2009 to $7.25 per hour.
